fa بررسی تطبیقی شرایط عقود اسلامی و قراردادهای پشتیبانی بانکداری اسلامی (مورد مطالعه: بانک شهر) تخصصي Special پژوهشي Research <div style="text-align: justify;"><span style="font-family:yekanyw;"><span style="font-size:14px;"><span dir="RTL"><span style="color:black;">اسلام، بر همه مسائل اجتماعی به خصوص روابط اقتصادی سالم، تأکید بسیاری دارد. آنچه سبب لزوم بررسی و تطبیق مسائل مربوط به قراردادها در اسلام و قراردادهای پشتیبانی در بانکداری اسلامی شده است، وجود قراردادهای متنوع در جامعه حاضر است. در این تحقیق تلاش بر این است تا پس از تعریف و تبیین قراردادها و اصول آن در آیات شریفه قرآن مجید و تشریح ماهیت آن، به بررسی انطباق قراردادهای پشتیبانی در بانکداری با عقود و موازین شرعی و توصیه شده در اسلام پرداخته شود.</span></span> <span dir="RTL"><span style="color:black;">شناسایی انواع قراردادها، بررسی مبانی مشروعیت و تبیین ارکان و آثار آنها در قراردادهای پشتیبانی در بانکداری اسلامی با رعایت تمامی جوانب آن در امور جاری بانک شهر صورت گرفته است. سؤال اصلی تحقیق حاضر این است که تا چه اندازه قراردادهای پشتیبانی بانک شهر، بر شروط توصیه و دستور داده شده در قراردادهای اسلامی، منطبق می‌باشند. در این راستا پنج نوع از قراردادهای مورد استفاده در مدیریت امور پشتیبانی بانک شهر، جهت تطبیق با شروط توصیه</span></span> <span dir="RTL"><span style="color:black;">شده در آیات شریفه قرآن مجید، بررسی و مطالعه شده‌اند. روش پژوهش در این تحقیق، تحلیل محتوای تلفیقی می‌باشد. یافته‌های تحقیق نشان دادند که در سه نوع از قراردادهای بانکداری (خرید اقلام، طراحی، تهیه و راه‌اندازی سیستم‌ها و سرویس و نگهداری تجهیزات) تا بیش از ۸۲ درصد انطباق و در دو نوع از قراردادها (واگذاری منافع و حق بهره‌برداری از زمین و اجاره ملک) تا ۹۱ درصد انطباق با شرایط و توصیه‌های اسلام برای عقد قرارداد، وجود دارد.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:16px;"><span style="font-family:times new roman;">Islam emphasizes all social issues, especially healthy economic relations. What has led to the need to examine and address the issues of contracts in Islam and the contracts of support in Islamic banking, is the existence of various contracts in the society. In this research, it is tried to examine the compatibility of the contracts of support in Islamic banking with the contractual and religious principles recommended in Islam, after defining and clarifying the contracts and principles in the verses of the Holy Quran and explaining its nature. Identifying types of contracts, examining the foundations of legitimacy and clarifying their pillars and effects in support contracts in Islamic banking, and observing all aspects of it in current affairs of the bank have been done. The main question of the present research is to what extent Bank Shahr support contracts comply with the provisions of the recommendations and orders in Islamic contracts. In this regard, five types of contracts used to support Bank Shahr have been investigated in order to comply with the recommended conditions in the Quranic verses of the Holy Quran. The research method in this study is integrated content analysis.
